These Terms of Service apply when you use the MY TCG website or purchase products from us.

This website is operated by MY TCG LIMITED, trading as MY TCG. In these Terms, “MY TCG”, “we”, “us” and “our” refer to MY TCG LIMITED.

Please read these Terms before placing an order. By submitting an order through our website, you agree to these Terms and the policies referred to within them.

Nothing in these Terms affects your statutory rights as a consumer.

MY TCG is an online-only retailer. The registered office is not a public shop, warehouse or customer collection point.

Please contact us before returning an item so that we can provide the appropriate return instructions and address.

2. About our store

MY TCG is an independent UK online retailer of genuine trading card games, collectible cards, playing cards and card-protection accessories.

Our product range may include sealed trading card products, booster packs, booster boxes, tins, collections, decks, playing cards and accessories from established brands and product lines.

We are an independent retailer and are not affiliated with, endorsed by or sponsored by any product manufacturer or brand owner unless clearly stated.

3. Using our website

You may use our website only for lawful purposes.

You must not:

use the website fraudulently or unlawfully;
interfere with the operation or security of the website;
introduce viruses, malware or other harmful material;
attempt to gain unauthorised access to the website or connected systems;
use automated systems to scrape or extract content in a way that disrupts the website;
impersonate another person or provide false information; or
infringe our rights or the rights of another person.

We may restrict access to the website where reasonably necessary to protect customers, our business, the website or other users.

4. Eligibility to place an order

By placing an order, you confirm that:

the information you provide is complete and accurate;
you are legally capable of entering into a contract;
you are authorised to use the payment method provided; and
you are purchasing for a lawful purpose.

Where a person under the age of 18 places an order, they should do so only with the involvement and permission of a parent or legal guardian.

5. Product information

We take reasonable care to ensure that product titles, descriptions, photographs, prices, availability and other information are accurate.

Product images are provided to help identify and illustrate the product. Colours and visual details may appear differently depending on the device or screen being used.

For products supplied in assorted designs, pack artwork, characters or configurations, the design received may be selected at random unless a particular option is expressly offered on the product page.

Booster packs and other randomised trading card products contain randomly selected contents. Specific cards, rarities, characters, artwork or card treatments cannot be guaranteed unless expressly stated.

Product packaging may occasionally be updated by the manufacturer. Minor packaging changes do not affect the customer’s rights where the product supplied is materially different from the description.

Please contact us before ordering if you require clarification about a product.

6. Product authenticity

All products offered for sale through MY TCG are sold as genuine retail products.

We source products through established distributors, wholesalers and other legitimate retail supply channels. We do not sell counterfeit, replica or unofficial products.

7. Prices and VAT

Prices are shown in pounds sterling.

Prices displayed on the website include VAT where applicable, unless clearly stated otherwise.

Delivery charges are shown separately during checkout before you submit your order.

We may change product prices at any time before an order is placed. A price change will not affect an order that we have already accepted, except where there is an obvious pricing error.

8. Placing an order

You can place an order by adding products to your basket, completing the checkout process and submitting payment.

Please review your order, delivery address and contact details carefully before submitting it.

After you place an order, we will send an automated order-confirmation email. This confirms that we have received your order but does not necessarily mean that the order has been accepted for dispatch.

A contract for the purchase of the goods is formed when we confirm that the order has been dispatched, unless we have expressly accepted the order at an earlier stage.

9. Order acceptance and cancellation by MY TCG

We may be unable to accept or fulfil an order where, for example:

the product is unavailable;
stock information was incorrect;
there is an obvious pricing or product-information error;
payment has not been authorised;
the delivery address is incomplete, invalid or outside an area we serve;
the order breaches a clearly stated purchase limit;
we reasonably suspect fraud, misuse or unauthorised payment activity; or
fulfilling the order would be unlawful.

We will not refuse or cancel an order for a discriminatory or otherwise unlawful reason.

If we cannot fulfil an order, we will contact you and refund any payment taken for the affected item or order to the original payment method.

10. Purchase limits and resale orders

Certain products may be subject to per-person, per-household, per-address or per-order purchase limits. Any applicable limit will normally be stated on the product page, collection page or promotional information.

We may cancel quantities that exceed a clearly stated limit, including where multiple orders appear to have been placed to avoid that limit.

We may also decline or reduce orders that reasonably appear to involve fraud, automated purchasing, attempts to bypass clearly stated purchase limits or misuse of a limited customer promotion.

Where an order is cancelled, any payment taken for the cancelled products will be refunded.

11. Payment

Payment must be made using one of the methods offered at checkout.

Payment processing may be provided by Shopify or another secure third-party payment provider. We do not directly receive or store full payment-card details where those details are processed by the payment provider.

You are responsible for ensuring that the billing and payment information supplied is accurate and that you are authorised to use the selected payment method.

12. Delivery

We currently deliver using the methods shown at checkout.

Processing times, delivery services, delivery charges and estimated timescales are explained in our Shipping Policy.

Delivery estimates are not guarantees unless a service is expressly described as guaranteed.

Please ensure that the delivery address provided at checkout is complete and accurate. Contact us as soon as possible if you identify an error. We cannot guarantee that an address can be changed after an order has entered processing or has been dispatched.

MY TCG remains responsible for the goods until they are delivered in accordance with applicable consumer law.

13. Ownership and risk

Responsibility for accidental loss or damage normally passes to you when the order is delivered to you or to a person you have identified to receive it.

Ownership of the goods passes to you once we have received full payment and the goods have been delivered.

14. Cancelling an order

Please contact us as soon as possible at sales@mytcg.co.uk if you wish to cancel or amend an order before dispatch.

We will do our best to assist, but we cannot guarantee that an order can be changed or stopped once processing has begun.

Customers normally have a statutory right to cancel an online purchase from the time the contract is formed until 14 days after receiving the goods.

15. Returns, refunds and faulty products

Our Refund Policy explains:

our extended 30-day returns period;
statutory cancellation rights;
return conditions;
return postage;
damaged, faulty, missing or incorrect products; and
how and when refunds are processed.

Nothing in these Terms or our policies limits your statutory rights in relation to goods that are faulty, damaged, incorrectly supplied or not as described.

16. Promotions and discount codes

Promotions and discount codes may be subject to additional conditions displayed at the time they are offered.

Unless otherwise stated:

discount codes cannot be exchanged for cash;
only one discount code may be used per order;
a code must be entered before the order is submitted;
discounts do not apply retrospectively;
purchase limits and eligibility conditions continue to apply; and
promotions may end or change before an order is placed.

Changing or ending a promotion will not alter an order that has already been accepted.

17. Customer accounts

You may be able to create a customer account to manage orders or access selected website features.

You are responsible for keeping your login details secure and for informing us promptly if you believe your account has been accessed without permission.

We may suspend or close an account where reasonably necessary because of suspected fraud, unlawful activity, serious misuse of the website or repeated breaches of these Terms.

18. Intellectual property

The original text, design and other content created by MY TCG LIMITED for this website belong to us or are used with permission.

You may not reproduce, republish, distribute or commercially exploit our original website content without prior written permission.

Third-party trademarks, product names, characters, logos, photographs and brand imagery remain the property of their respective owners. Their appearance on our website is used to identify and describe genuine products offered for sale and does not imply an affiliation or endorsement.

19. Third-party services and links

Our website is hosted by Shopify and may use services provided by payment processors, delivery providers and other third parties.

The website may also contain links to third-party websites. We are not responsible for the content, availability or privacy practices of websites that we do not operate.

A link to another website does not necessarily mean that we endorse that website or its products or services.

Nothing in this section limits our responsibility for the products you purchase directly from MY TCG.

20. Privacy and personal information

Our handling of personal information is explained in our Privacy Policy.

Information submitted during checkout may be shared with service providers where necessary to process payment, fulfil the order, deliver the goods, prevent fraud or provide customer support.

21. Website availability

We aim to keep the website available and operating correctly, but we cannot guarantee uninterrupted access.

We may temporarily suspend or restrict parts of the website for maintenance, security, updates or circumstances outside our reasonable control.

This will not affect an order that has already been accepted or any rights you have in relation to an existing purchase.

22. Our responsibility to you

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not foreseeable when the contract was formed.

We supply products for private and personal use. We are not responsible for business losses, including loss of profit, revenue, business opportunity or anticipated savings, arising from a consumer purchase.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:

death or personal injury caused by negligence;
fraud or fraudulent misrepresentation;
defective products where liability cannot legally be excluded; or
your statutory rights as a consumer.

23. Circumstances outside our reasonable control

We are not responsible for delay or failure caused by circumstances outside our reasonable control, such as severe weather, postal disruption, transport disruption, system outages, industrial action, government restrictions or failures affecting essential suppliers.

Where such circumstances affect an existing order, we will take reasonable steps to minimise the impact and keep you informed where appropriate.

Your statutory rights, including any right to cancel where delivery is significantly delayed, are not affected.

24. Complaints

Please contact us if you are dissatisfied with a product, an order or the service you have received.

We will review the matter and aim to provide a fair response as soon as reasonably possible.

25. Changes to these Terms

26. Severability

If any part of these Terms is found to be unlawful or unenforceable, the remaining sections will continue to apply.

27. No waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.

28. Governing law

These Terms and any contract between you and MY TCG LIMITED are governed by the laws of England and Wales.

Nothing in this section deprives a consumer of any mandatory legal protections that apply in the part of the United Kingdom in which they live.
